PROBATE AND TRUST ADMINISTRATION

PROBATE AND TRUST

ADMINISTRATION

There are some circumstances when probate either cannot be avoided or should not be avoided. Dealing with the loss of a loved one is difficult on its own, and the added pressures and responsibilities of making legal decisions do not help. Clients can take comfort in relying on the expertise that Shinners & Cook offers in guiding them through the probate process.

PROBATE OF AN ESTATE

Our probate attorneys can provided assistance throughout the probate process including: appointing and assisting the Personal Representative, providing the proper notification to all interested parties or heirs, filing the necessary paperwork with the Probate Court and local newspaper, and distributing assets to beneficiaries. A primary responsibility of our probate practice is to protect the Personal Representative and minimize exposure or liability by complying with Michigan’s probate laws.

TRUST ADMINISTRATION

The period of time after a loved one passes away can be the most difficult. Yet often times important decisions must be made, businesses continued to be managed, and obligations and outstanding debts be paid. Having a Trust in place can often alleviate some of these stresses, and Shinners & Cook is here to assist clients by helping them manage and administer their loved one’s Trust.

Trust administration may range from a single distribution to Trust beneficiaries without the need to open a probate, to administration that may last for years for the benefit of caring for minor children. Whatever the case, the expertise at Shinners & Cook can help make Trust administration as smooth as possible for the Trustee while also protecting against any potential liability.
